Liability Release and Assumption of Risks related to participation in a tour package

I, the undersigned, hereby acknowledge that I have voluntarily chosen to participate in the tour organized by Le Paradis Haitien(LPH). In consideration of being permitted to participate in this tour, I hereby agree to release and discharge Le Paradis Haitien(LPH), its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, actions, or demands that may arise out of, or in connection with, my participation in the tour.

I am aware that Le Paradis Haitien(LPH) is an Haitian based adventure travel company that organizes, promotes, and sells tour programs consisting of certain travel services that are purchased or reserved from various suppliers on my behalf. In doing so, Le Paradis Haitien(LPH) acts only as an intermediary for the various independent suppliers that provide accommodations, meals, transportation, sightseeing, activities and other goods and services connected with all tours (“Supplier” or “Suppliers”). I acknowledge that I am aware of and clearly understand that these suppliers are independent contractors, are not managed by Le Paradis Haitien(LPH) and are not agents or employees of Le Paradis Haitien(LPH). I acknowledge that Le Paradis Haitien(LPH) assumes no responsibility for and cannot be held liable for any negligent act, willful act, or failure to act for any Supplier, or of any other person or entity. I am aware that Le Paradis Haitien(LPH) is also not responsible for the financial default of any Supplier.

I understand and acknowledge that the tour may involve certain risks and hazards, including but not limited to:

- Transportation risks, including accidents, mechanical failures, and delays.
- Risks associated with outdoor activities, such as hiking, trekking, or water sports.
- Exposure to natural elements, including adverse weather conditions, wildlife, and rough terrain.
- Risks associated with visiting unfamiliar locations, including cultural differences, language barriers, and local laws and customs.
- Risks associated with group travel, including conflicts with other participants, unforeseen emergencies, and unforeseeable events.


I acknowledge that the tour organizer has taken reasonable precautions to ensure the safety and well-being of participants. However, I understand that certain risks are inherent in the nature of the tour and cannot be completely eliminated.

By signing this document, I assume full responsibility for any risks, injuries, damages, or losses that I may incur during the tour, including those that result from my own actions or negligence. I agree to comply with all instructions, rules, and regulations provided by the tour organizer and to exercise caution and good judgment at all times.

I further acknowledge that participation in the tour is entirely voluntary and that I have not been coerced or pressured in any way to participate. I certify that I am in good health and physical condition and that I do not have any medical conditions that would prevent me from participating safely in the tour.

In consideration of being permitted to participate in the tour, I hereby release, waive, discharge, and covenant not to sue Le Paradis Haitien(LPH), its officers, directors, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of, or in connection with, my participation in the tour.

I understand that by signing this document, I am giving up certain legal rights, including the right to sue Le Paradis Haitien(LPH) for any injuries, damages, or losses that I may sustain during the tour. I acknowledge that I have read and fully understand the terms of this Liability Release and Assumption of Risks agreement, and I voluntarily agree to be bound by its terms.

I AGREE THAT THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives; it being my intention to fully assume all risks associated with this trip and to release Le Paradis Haitien(LPH) from any and all liability to the maximum extent permitted by law.

Photo Release:

I, the undersigned, hereby acknowledge that I am participating in the tour package organized by Le Paradis Haitien(LPH). In consideration of being allowed to participate in the tour, I hereby grant permission to Le Paradis Haitien(LPH) to use my likeness, image, and/or voice in photographs, videos, or other media recordings captured during the tour for promotional and marketing purposes.
